State Organization V. Mamutov Institute of Economic and Legal Research of NAS of Ukraine was created on the basis of economic-legal research Department at the Institute of Industrial Economics of NAS of Ukraine in accordance with the Decree of the Presidium of NAS of Ukraine from January 22, 1992 № 16 with the aim of actual problems solution of economic development legal support at national and regional levels.

The establishment of the Institute was due to the need for developing the theoretical and applied research at the interface of economics and law, scientific and practical significance of such studies for a sovereign state.

The Institute conducts and coordinates the basic economic and legal research, carries out the scientific and applied research, prepares the scientific expertise and provides an advice in the sphere of legal support of the economy, legal regulation of economic activity, management of regional and urban systems as well as provides training on the research results of normative-legal projects acts that are very necessary for their implementation.

Structure of the Institute comprises: department of economic law problems modernization and legislation, department of economic-legal support of economic security, division of economic and legal problems of city building, department of spatial economy development as well as Luhansk branch of interregional cooperation problems department. The auxiliary functions have been done by the department of scientific information.

During the whole period of the Institute’s development it’s staff has played a role of pioneer who clearing the way for further development of economic law science that explores the problems of legal support economy. At present the Institute continues to actively promote the full learning and teaching of economic law at the universities, developing a systematic approach to the improvement of economic legislation. All this, in turn, creates the conditions for the formation of young generation of scientists-specialists in economic law, training the lawyers to work in the national economy and legal training of economists and managers.

According to the Decree of the Presidium of NAS of Ukraine “On scientific and scientific-organizational activity of the Institute of Economic and Legal Research of NAS of Ukraine” dated 28.02.2007, No. 59 for the Institute has approved the following main directions of scientific activity:

  • economic law;
  • state regulation of the economy;
  • economic and legal problems of socio-economic development of territorial systems and the distribution of powers between central governments and regions;
  • legal support of entrepreneurship, formation of new organizational and economic structures;
  • economic-legal problems of prevention of economic offences;
  • harmonization of legislative acts that are regulating the economic relations.

The results of economic and legal studies were brought to realization at the level of laws. During the discussions, the opposition by representatives of other scientific schools were defined and through the media appearances and by the direction of the position papers to the Verkhovna Rada of Ukraine, President of Ukraine, the Cabinet of Ministers of Ukraine the resistance that had always come from officials was ruined. The main (but not only) law — the Economic Code of Ukraine, the adoption of which overcoming the resistance, was achieved with the help of the Presidium of NAS of Ukraine, people’s deputies of like-minded people and lawyers, it has become a serious progressive stage of many working years by the researchers, practitioners and people deputies.

Economic and legal researches are distinguished by the fact that on their basis it is possible and necessary not only to publish the results but also to bring these results to the specific economically and legally draft legal acts. These studies should be carrying out by the economists and lawyers or specialists with economic and legal education.

The main theme of the Institute’s scientific research is to cover the actual problems of social, legal, democratic state formation. In this connection there is the need to overcome the influence of the market fundamentalism ideology, on the one hand, and the existence of administrative voluntarism on the other. It determined the need not only to move beyond the publication of research results but to engage in scientific and journalistic activities in order to ensure the accomplishment of these results, overcoming the resistance of their introduction by opposing forces.

The Institute trains the highly qualified scientific personnel through the postgraduate and doctoral studies of economic and legal sciences. The Institute has a specialized scientific Council with the right of dissertation protection on competition of a scientific degree of doctor and candidate of Sciences. During the last 20 years in the Councils of the Institute were defended 144 doctoral thesis in Economics and 135 in Low.

The scientists from the Institute are the members of editorial boards of several universities as well as members of editorial boards of many scientific journals.

The results of work over the past twenty years have proved the necessity and feasibility of further development of economic and legal studies. Therefore, the priority tasks of the Institute in the future is the continuation and deepening of studies aimed at legislative support of economic policy, including the improvement of the constitutional bases of the policy and economic legislation, in particular, by consolidating, “compaction” of legislation, capacity of the Commercial Code of Ukraine as well as the research aimed at optimizing the allocation of powers in matters of socio-economic development between levels of government.
